Liability Waiver

Every participant at Clermont RC Complex must read, understand, sign, and date this Liability Waiver before entering the track, pit area, or lake. Minor participants (under 18) must have this waiver signed by a parent or legal guardian. Waivers are also available on-site.

Liability Waiver, Release of Claims, Assumption of Risk, and Indemnity Agreement

In consideration of being permitted to enter the premises of Clermont RC Complex, located at 12351 Sullivan Road, Clermont, Florida 34715 ("the Facility"), and to participate in radio-controlled vehicle activities, practice sessions, club races, elite events, tuning sessions, boat operation on the lake, and any related activities (collectively, "the Activities"), I, the undersigned participant (or the parent/legal guardian of the undersigned minor participant), agree as follows:

1. Acknowledgment of Risks

I acknowledge that participation in radio-controlled vehicle Activities involves inherent risks, including but not limited to: high-speed vehicle impacts; flying debris including dirt, rocks, plastic, and metal fragments; battery fires, thermal runaway, and lithium-polymer battery explosions; nitro fuel spills, burns, and inhalation; drowning, hypothermia, or watercraft accidents on the lake; slips, trips, falls, and collisions in the pit and driver's stand area; sunburn, heatstroke, dehydration, and other weather-related conditions; encounters with wildlife including snakes, alligators, and insects; equipment failure or malfunction; and the negligent or reckless acts of other participants, spectators, or third parties.

2. Assumption of Risk

I voluntarily and knowingly assume all such risks, both known and unknown, and accept full responsibility for any injury, property damage, illness, disability, or death that may result from participating in the Activities, whether caused by the negligence of Clermont RC Complex, its owners, employees, volunteers, agents, contractors, or otherwise.

3. Release and Waiver

I hereby release, waive, discharge, and covenant not to sue Clermont RC Complex, Sullivan Road properties, and their respective owners, officers, directors, members, employees, volunteers, agents, contractors, sponsors, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Activities, while in, on, or upon the Facility, or while traveling to and from the Facility.

4. Negligence Release

I specifically understand and agree that this Release includes claims based on the ordinary negligence of the Released Parties. It does not release the Released Parties from liability for gross negligence, willful misconduct, or intentional acts.

5. Rules and Removal

I agree to abide by all posted rules, verbal instructions from Clermont RC Complex staff or race officials, and any published race regulations. I understand that Clermont RC Complex reserves the right to remove any participant from the Facility at any time, without refund, for unsafe operation, unsportsmanlike conduct, intoxication, or violation of the rules.

6. Equipment Responsibility

I am solely responsible for the condition, safe operation, and legal compliance of my radio-controlled vehicle(s), batteries, chargers, fuel, tools, and all related equipment. I confirm that my equipment is in safe operating condition and that I have the skill and experience necessary to operate it safely. Clermont RC Complex does not inspect, certify, or take custody of participant equipment.

7. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, brought as a result of my involvement in the Activities, and to reimburse the Released Parties for any such expenses incurred.

8. Medical Authorization

I authorize Clermont RC Complex and its staff to administer basic first aid and, in the event of a medical emergency, to call for emergency medical services on my behalf or on behalf of the minor participant named below. I acknowledge that I am financially responsible for any medical treatment received and that Clermont RC Complex does not provide medical insurance for participants.

9. Photo, Video, and Media Release

I grant Clermont RC Complex permission to photograph, film, record, and use my likeness, voice, and image (and that of any minor for whom I am the parent or legal guardian) in any medium — including social media, print, video, streaming, and website content — for promotional, educational, or commercial purposes, without further notice, compensation, or approval. I waive any right to inspect or approve the finished use of any such media.

10. Spectators and Guests

I understand that this Waiver applies not only to me as a driver or racer but also to any guest, spectator, family member, or minor whom I bring onto the Facility. I represent that I have the authority to sign this Waiver on their behalf, and I assume responsibility for their conduct, safety, and compliance with the rules while at the Facility.

11. Minor Participants — Florida Statutory Waiver

If the participant is under the age of 18, this Waiver is signed by the participant's parent or legal guardian pursuant to Florida Statutes § 744.301(3), which permits a natural guardian to release the inherent risks of activity on behalf of a minor child. The undersigned parent or guardian represents that they have full legal authority to sign on behalf of the minor and voluntarily agree to release, waive, and covenant not to sue the Released Parties for injuries to the minor arising from the inherent risks of the Activities.

12. Rain Checks, Refunds, and Cancellations

Day passes, race entries, and event tickets are non-refundable. In the event of full-day cancellation by Clermont RC Complex due to severe weather or unsafe track conditions, Clermont RC Complex may, at its sole discretion, offer a rain check for a future practice or race day. Membership fees are non-refundable except as provided in the individual membership terms.

13. Alcohol and Substance Policy

Operating a radio-controlled vehicle or watercraft while impaired by alcohol, illegal drugs, or medication that impairs judgment or reaction time is strictly prohibited. Violators will be immediately removed from the Facility without refund.

14. Governing Law and Venue

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising out of or related to this Waiver or the Activities shall be brought exclusively in the state or federal courts located in Lake County, Florida, and I consent to the personal jurisdiction of those courts.

15. Severability

If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

This Waiver represents the entire agreement between me and Clermont RC Complex regarding the release of liability and assumption of risk. It supersedes any prior oral or written representations. No modification is valid unless in writing and signed by an authorized representative of Clermont RC Complex.

17. Acknowledgment

I have read this Waiver in its entirety. I understand it. I have had the opportunity to ask questions. I sign it freely and voluntarily. I understand that by signing this Waiver, I am giving up substantial legal rights, including the right to sue.
